TERMS AND CONDITIONS FOR ONLINE BONUS POINT SCHEME ("Terms and Conditions")

1. Introduction

The Online Bonus Point Scheme (the "Scheme") is only open to personal/sole proprietorship customers who have registered as users of the Online Banking Services. (the "Customers") of China Construction Bank (Asia) Corporation Limited (the "Bank") for conducting banking and/or investment transactions.



2. The Scheme

The Scheme is offered subject to these Terms and Conditions. Any matter or dispute in connection with the Scheme shall be determined in the manner as prescribed by the Bank and in accordance with these Terms and Conditions (as amended from time to time). By participating in the Scheme, a Customer shall be deemed to have accepted these Terms and Conditions and shall be bound by them.



3. Bonus Points

(a) The Bank will award bonus points under the Scheme (the "Bonus Points") to a Customer for using the Online Banking Services to effect the services or transactions as the Bank may specify in the Bank's web site from time to time (the "Transaction"). Bonus Points awarded under the Scheme are not transferable.

(b) Bonus Points will be awarded to each successfully completed and/or executed Transaction effected through the Online Banking Services.

(c) The Bank reserves the exclusive right to decide on and vary the quantity of Bonus Points to be awarded for each Transaction. The Bank is also entitled to prescribe any minimum or maximum limits or other conditions in relation to (i) Bonus Points to be awarded under the Scheme, (ii) the manner of redemption of Bonus Points for cash rebate to pay for transaction fees for designated investment/insurance transactions, gifts, goods, services or other rewards under the Scheme (collectively, the "Rewards"). Please check the bonus point table published by the Bank from time to time for updated information.

(d) Bonus Points earned from September 1 of the previous year to August 31 of the current year (if any) are valid until the end of the current calendar year (i.e. December 31) (the "Expiry Date") unless the Bank agrees otherwise. The Bank is entitled to change the Expiry Date of any or all of the Bonus Points awarded to the Customer by notification. Bonus Points accumulated by a Customer which are not redeemed for Rewards shall, unless the Bank agrees otherwise, expire and be automatically cancelled on close of business on the Expiry Date (or such other date as agreed by the Bank).

(e) The Bank will update the Bonus Points accumulated by and available for redemption by a Customer on a daily basis. The Customer can check the Bonus Points accumulated and available for his/her redemption via the Online Banking Services. The Bank's records with respect to the Bonus Points accumulated and available for redemption by the Customer are conclusive and binding on the Customer.

(f) In case of a joint account held in the name of two or more Customers, all Bonus Points awarded for Transactions conducted through the joint account by any of the account holders will be awarded to the joint account. A nominee shall be appointed by the joint account holders (from amongst themselves) by a prescribed form so as to be authorized to administer the redemption of the Bonus Points and the collection of the Reward(s) ("Nominee"). The Bank will not entertain any application for redemption of the Bonus Points unless such application is made in the form as provided by the Bank from time to time and executed by the Nominee. In the event of any disputes in relation to the computation and pooling of the Bonus Points, the decision of the Bank shall be final and binding on the Customers.

(h) Double Bonus Points will be awarded to Customer for Transactions successfully effected or executed in the Customer's birthday month. For joint accounts, only the Nominee of a joint name account may be entitled to double Bonus Point offer under this clause in his/her birthday month.

(i) No bonus point will be granted for any transaction executed or effected through Online Banking Services before the commencement date of the Scheme.

(j) The calculation of Bonus Points will be based on the transaction amount in Hong Kong dollar equivalent unless otherwise specified by the Bank. The currency conversion will be effected at the prevailing rates determined by the Bank on the day of the conversion.

(k) All Bonus Points accumulated by a Customer but not redeemed shall be cancelled (without any compensation or alternative arrangement thereof) upon termination of all or any of the banking services by the Customer or by the Bank for any reason.

(l) Bonus Points are awarded to each account of the Customer on a per account basis. Customer(s) maintaining more than one account with the Bank cannot consolidate his/her/their transactions in other accounts in the calculation of Bonus Points. Bonus Points awarded under different accounts of the Customer may, however, be consolidated for redemption of the Rewards.

(m) The respective cash values of each Bonus Point awarded for Transactions executed or effected through Online Banking Services shall be such amount applicable at the time of redemption of the Bonus Points and the respective cash values may not be the same. The cash value of each Bonus Point (whether awarded for Transactions executed or effected through Online Banking Services ) may change from time to time at the exclusive discretion of the Bank, in which case the changes shall be notified to the Customers in the Bank's website or other means the Bank deems appropriate.

4. Redemption of Rewards

(a) The Bank may at its sole discretion specify and vary the Rewards available for redemption under the Scheme and the quantity of Bonus Points required for redeeming the respective Rewards from time to time.

(b) Once a redemption application ("Application") has been accepted by the Bank, no cancellation, or alteration of such Application can be made by the Customer without the Bank's consent. A Customer is required to redeem the Bonus Points for Rewards by following the procedures as prescribed by the Bank (or as notified to the Customer from time to time). A Customer has to allow at least 2 to 4 weeks for the Bank to process any Application.

(c) The Bank is not obliged to accept any Application from a Customer if the account(s) for the execution of the Transactions maintained by the Customer with the Bank is not, according to the Bank's records, in a normal and active status. The Bank also reserves the right to reject any Application if the Customer has been in breach of his/her obligations in relation to the use of the banking services.

(d) Bonus Points which have expired cannot be used to redeem Rewards and will not be replaced by the Bank. In no circumstances will a Customer be allowed to redeem any Bonus Points for cash except for rebate to pay for transaction fees for designated investment/insurance transactions with the Bank.

(e) Subject to the Bank's agreement, a Customer may choose to collect the Reward from the Branch specified by the Customer or, where if applicable, to receive the Reward by post. The Bank is not obliged to provide or procure any delivery service, free or otherwise. If the Customer does not collect the Reward within the period specified by the Bank in the collection notice, the Customer will be deemed to have forfeited the Reward. The Bank is entitled to require the Customer or any person designated by the Customer to collect the Reward to produce the collection notice and proof of identity and authorization.



5. The Rewards and the Bank's Responsibility

(a) All Rewards are subject to availability and will be provided on a first-come-first-serve basis. The Bank reserves the right to replace any Reward product with an alternative product without prior notice.

(b) The Bank may at its sole discretion prescribe any conditions for the manner of redemption and the type of Reward available to a Customer under the Scheme including, without limitation, any time period within which the Reward will be available.

(c) Rewards under the Scheme may be provided directly to a Customer by any person other than the Bank (the "Supplier") or supplied by any Supplier to the Bank for provision to the Customer.

(d) Any Reward provided or supplied by a Supplier may be subject to any conditions prescribed by that Supplier. A Customer has to address and/or resolve any comment, claim, complaint or dispute concerning such Reward (whether concerning availability, quality or quantity) to and with the Supplier who had provided or supplied such Reward direct.

(e) The Bank assumes no responsibility of any kind or nature in relation to any Reward provided or supplied by any Supplier. The Bank does not endorse any Supplier or any Reward provided or supplied by any Supplier, nor does the Bank provide any guarantee or warranty relating to any Supplier or any Reward provided or supplied by any Supplier. Any information or materials about any Supplier or any Reward provided or supplied by any Supplier shall not be regarded as representations or warranties given by the Bank in relation to the relevant Supplier or Rewards, and the Bank has no duty to investigate or verify the accuracy or completeness of such information, materials or the quality of the Reward.

(f) The Bank is not responsible for lost, stolen, damaged or defected Rewards redeemed through the Scheme.

(g) In case of any dispute arising from the Scheme, the decision of the Bank shall be final.



6. Variation of Terms and Conditions

The Bank reserves the right to revise these Terms and Conditions from time to time by giving notice to the Customers through the Bank's website or other means the Bank deems appropriate. Such amendment will become effective and binding on the Customer on the date specified by the Bank and the Customer's continuation of using the Online Banking Service after such date shall constitute the Customer's agreement to the amendment.



7. Acknowledgment

The Customer hereby represents and warrants to be fully aware, understand and accept the full contents and information of these Terms and Conditions and that it has been properly and fully informed by the Bank of all its contents.

Where there is any inconsistency between the English version of these Terms and Conditions and the Chinese translation, the English version shall prevail.
