Terms and Conditions for Online Customer Services

    Important Notes:

    The Online Customer Services are the automated service and channel provided by China Construction Bank (Asia) Corporation Limited (the "Bank", "we", "us" or "our" which shall include the Bank’s successors, assigns, transferees and any person deriving title under any of them).

    All information provided through the Online Customer Services is for the purposes of responding to general enquiries only. Please note that the information provided under the Online Customer Services shall not constitute any offer of any specific products or services, and shall not constitute nor be relied upon as any advice given by the Bank.

    Certain functions under the Online Customer Services are only available to customers of the Bank, after logging into the Bank's system. In particular, you are required to log into your online banking accounts before using specific functions under the Online Customer Services, in respect of your accounts with the Bank and your transaction through the Bank.

    Please read the Terms and Conditions for Online Customer Services ("T&Cs") and Bank's Terms of Use and Privacy Statement and Personal Information Collection Notice carefully before using the Online Customer Services.

    By continuing using the Online Customer Services, you agree with the T&Cs. The T&Cs constitute a binding legal agreement between you and the Bank for the use of the Online Customer Services.

    The T&Cs, in addition to the following documents, which should be read in conjunction with the T&Cs and are incorporated by reference, form an integral part of the T&Cs and shall apply to the Online Customer Services:

    In the event of a conflict between the T&Cs and any of the General Terms, the T&Cs will prevail to the extent of such conflict, insofar as the Online Customer Services are concerned.

    We may amend, revise or replace the T&Cs and the General Terms (as applicable) and/or introduce additional terms and conditions from time to time at our sole discretion. By continuing to use the Online Customer Services following any amendment, you will be deemed to have accepted the amended T&C or General Terms (as applicable). If you do not agree to any such amendments, you should stop using the Online Customer Services.

  1. Provision of Online Customer Services
    1. 1.1You must read these T&Cs carefully before using the Online Customer Services. By using any of the services, you shall be deemed to have accepted and be bound by these T&Cs and the General Terms and to have acknowledged that you understand the inherent risks of the Online Customer Services.
    2. 1.2The Online Customer Services are the automated service of the Bank for responding to general enquiries about our products and services, information on your accounts with the Bank, and supporting your banking transaction instructions. The scope of services and functions available through the Online Customer Services, and the persons to whom the Online Customer Services are made available, will be determined and is subject to changes by us from time to time at our sole discretion. The Online Customer Services and any products or services referred to through the Online Customer Services are only available to persons and in the jurisdictions to the extent permissible under applicable laws, rules and regulations. The Online Customer Services and the content are not intended to be accessed or used by any person who is located or resides in any jurisdiction with restrictions on such access or use.
    3. 1.3The Online Customer Services are available via the following channels ("Channels") subject to changes as determined by the Bank at our sole discretion from time to time:
      1. a.CCB (HK&MO) Mobile App ("Mobile Personal Banking Channel");
      2. b.our online personal banking and private banking channel ("Online Personal Banking and Private Banking Channel");
      3. c.our online enterprise banking channel ("Online Enterprise Banking Channel");
      4. d.our official WeChat account (ID: ccbasiahk) (the WeChat platform offered by WeChat is referred to as the "WeChat Official Accounts Platform");
      5. e.our website; and
      6. f.such other channels as approved by the Bank from time to time.
    4. 1.4The functions available through the different Channels include making general enquires about our products and services, but do not include any account or transaction specific functions. The functions available through the different Channels are subject to changes determined by the Bank at our sole discretion from time to time.
    5. 1.5The Online Customer Services for all Channels supports text input in English, Traditional Chinese and Simplified Chinese. The language and input mechanisms are subject to changes as determined by the Bank from time to time.
    6. 1.6The Bank grants you a personal, limited, non-exclusive, revocable, non-transferable and non-sublicenseable license to use the Online Customer Services under these T&Cs. The Bank may provide certain portions and functions of the Online Customer Services under license from third parties, and you shall comply with any additional terms and restrictions on their usage as notified by the Bank from time to time.
    7. 1.7You acknowledge and agree that the content available via the Online Customer Services are not and should not be regarded as any offer, solicitation or recommendation in respect of any specific products or services; and is not, is not intended to be and shall not be relied upon as any investment advice or other advice of any nature.
    8. 1.8You acknowledge that the information provided via the Online Customer Services may not have been investigated, verified, monitored or endorsed by the Bank. The Bank does not warrant the accuracy, reliability, timeliness, completeness or correct sequencing of any such information nor bear any legal liability for loss arising from any inaccuracy, omission or incompleteness of such information, regardless of whether the information is provided by us or any third party. In particular, you acknowledge and agree that the Bank has no responsibility or liability for any information provided by or sourced from a third party (including those accessible via hyperlinks through the Online Customer Services), and you shall be responsible for making your own enquires and investigations as you consider appropriate before accessing or using any third party websites and information or services of third parties.
  2. Use of the Online Customer Services
    1. 2.1Your access to and your use of the Online Customer Services are possible without providing the Bank with any personal information or account information. The functions available through the Online Customer Services are general in nature and do not relate to you, your accounts or your transactions. You are reminded to keep any username, password, security code or other personal account information secure and confidential and not to disclose any such information when accessing the Online Customer Services.
    2. 2.2You understand, accept and undertake that:
      1. a.you are solely responsible for your use of the Online Customer Services and any information, content or material you provide through the Online Customer Services, and the Bank has no responsibility to you or any other person for your actions or omissions;
      2. b.you shall use the Online Customer Services and any information, content or material made available on the Online Customer Services only for the purposes that are expressly permitted under these T&Cs and must fully comply with these T&Cs, the General Terms and any other terms and conditions provided by the Bank from time to time;
      3. c.you must comply with all applicable laws, rules and regulations and the user guides, policies and procedures applicable to the Online Customer Services; and you must not use the Online Customer Services in any manner in breach of these T&Cs, or act fraudulently or maliciously;
      4. d.the Online Customer Services are made available for your own personal use and you must not use the Online Customer Services on behalf of third parties. You may not use the Online Customer Services for any commercial, business or resale purposes;
      5. e.you must not breach, infringe or contravene or threaten to breach, infringe or contravene our rights or the rights of any third parties in connection with your access or use of the Online Customer Services;
      6. f.you must not use the Online Customer Services in a manner that may adversely affect the reputation of the Bank, our affiliates or third party licensors;
      7. g.you must not use the Online Customer Services in any way or engage in any activity that could damage, disable, overburden, impair, compromise or otherwise disrupt any part of the Online Customer Services or any related data, software, website, mobile app, device, system, server and network, or those of other users and third parties;
      8. h.you must not upload, submit, post or transmit any data, information or material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful program or computer code which may damage or otherwise adversely affect the Online Customer Services or any related data, software, website, mobile app, device, system, server and network;
      9. i.you must not use the Online Customer Services to send, communicate or upload any information, content or materials, or engage in any activities that are harassing, offensive, fraudulent, abusive, threatening, indecent, defamatory, obscene or menacing, or to send any unsolicited communications, promotions, advertisements or spam messages;
      10. j.you must not harvest any information or data from or through the Online Customer Services or any related systems, servers and networks or attempt to decipher any transmissions to or from the Online Customer Services, systems, servers and networks;
      11. k.you must not and shall not allow any other person to tamper with, modify, decompile, reverse engineer or otherwise alter or gain unauthorised access to any part of the Online Customer Services or any related data, software, website, mobile app, device, system, server and network;
      12. l.you must not modify, reproduce, sell or re-sell, distribute, publish or re-publish or create derivative work from the Online Customer Services or any information, content, materials and work from the Online Customer Services;
      13. m.you must take reasonable measures to ensure that any computer, mobile or other electronic device used to access the Online Customer Services are protected from virus or malicious software, and you acknowledge that to the maximum extent permitted by applicable law, the Bank is not responsible for any loss or damage as a result of any computer viruses, Trojan horses, worms, software bombs, malware or similar processes arising from your use of the Online Customer Services; and
      14. n.the Bank may provide links to websites and hyperlinks which are provided by our group or affiliated companies and the terms and conditions governing the use of such websites and hyperlinks may be different from those of the Bank, and you must read and understand those terms and conditions carefully before entering, accessing or using such websites and hyperlinks. The Bank will have no liability, whether based on contract, tort or otherwise, for any reliance by you or any other person on any commentaries, information or other data supplied through or made available via the Online Customer Services.
      Without prejudice to the Bank’s rights under clause 9 herein, you understand and accept that the Bank may terminate your use of the Online Customer Services if the Bank reasonably believes that you have breached any of the above undertakings.
    3. 2.3Without prejudice to other terms herein, you understand and accept that the Bank has the sole discretion to do any of the following, at any time, without notice to you:
      1. a.modify, suspend or terminate the operation or access to the Online Customer Services, or any portion of the Online Customer Services, for any reason;
      2. b.modify or change the Online Customer Services, or any portion of the Online Customer Services; or
      3. c.interrupt the operation of the Online Customer Services, or any portion of the Online Customer Services, as necessary to perform routine or non-routine maintenance, error correction or other changes.
    4. 2.4You understand and accept that the Bank may from time to time require updates to the Online Customer Services which must be installed in order to enable the proper functioning of the Online Customer Services. You acknowledge that it is your sole responsibility to update your computer, mobile device or other electronic device and/or access or download the latest updated version of the website or mobile app to access the Online Customer Services. To the maximum extent permitted by applicable law, the Bank shall not be liable for any loss or damage due to your inability to access the Online Customer Services if you fail to take actions aforesaid.
  3. Privacy
    1. 3.1The Bank recognises the importance of respecting your privacy. The Bank's Notice to Customers relating to the Personal Data (Privacy) Ordinance (as the same may be supplemented and amended from time to time) ("Privacy Notice") provides information on how the Bank collects, uses, shares, and protects your personal data related to any data provided to the Bank, as well as the choices and access rights you have in regard to your personal data. By using the Online Customer Services, you are bound by these terms. In particular, you acknowledge that the Bank will provide your personal data to its affiliates and third party service providers in accordance with the Privacy Notice.
    2. 3.2Without limiting the generality of the Bank's Privacy Notice the content of your interactions with the Bank through the Online Customer Services (including but not limited to any voice, text and document) will be recorded and analyzed by the Bank. Such data may be used, retained, disclosed, transferred and accessed for the provision, accuracy and quality enhancement of the services and for such other purposes as stated in the Privacy Notice.
    3. 3.3The Bank will not disclose or ask you to disclose any sensitive personal or account information in its full form when we interact with you via the Online Customer Services. You shall avoid disclosing personal or account information when using the Online Customer Services unless you are making enquiries about your account or transaction and you are being asked by the Bank to provide partial information for verification purposes.
    4. 3.4The Bank may use technology such as cookies to monitor and analyse the information provided by you and the communications through the Online Customer Services, and the Bank may use such information and content for the purposes of the Online Customer Services training or enhancement, or the provision of products or services by us. Online Customer Services may send push notifications to you. You acknowledge and agree that for the purposes stated above, the Bank may collect, transmit, store and use data in a form that does not, on its own, permit direct association with any specific individual. Such data includes but is not limited to technical information about your computer and/or device such as IP address, unique device identifier, and device type, information about the operating system and application software used on your computer and/or device and other non-personal information. If you do not wish to receive push notifications from Online Customer Services, you shall adjust settings in your electronic device.
    5. 3.5For quality and verification purposes, the Bank may retain the information and data obtained by the Bank from you through the Online Customer Services (including a transcript of all communications with the Online Customer Services) for a period of 7 years or such other period as determined by the Bank from time to time. The Bank will not retain personal data for longer than is necessary for the fulfillment of the purpose (including any directly related purpose) for which the data is or is to be used.
    6. 3.6The Bank may collect and process your geolocation data during your use of the Online Customer Services. The data will be used for the purpose of tailoring our services to your current location and for the purposes of answering your enquiries on the Online Customer Services.
  4. Security
    1. 4.1You are solely responsible for the security of your computer, mobile device, and other electronic devices, and you must take reasonable precautions to prevent any unauthorised or fraudulent use of your devices.
    2. 4.2You must keep any username, password and security code secure and confidential and must comply with the related provisions in the General Terms.
    3. 4.3You must notify the Bank as soon as reasonably practicable upon any notice or suspicion of your username, password, and/or security code being lost, stolen, compromised, or accessed or used without your authorisation.
    4. 4.4You are solely responsible for ensuring adequate protection and back-up data of your mobile device, computer or any other electronic devices used to access the Online Customer Services, for taking reasonable precautions to scan for computer viruses or other destructive properties, and for preventing (and guaranteeing and ensuring the prevention of) the transmission of any computer virus or other destructive properties to your mobile device, computer or any other electronic devices.
    5. 4.5By using the Online Customer Services, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you receive using the Online Customer Services may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
    6. 4.6You shall be solely responsible for adopting the appropriate safeguards (including the measures set out in relevant terms in the General Terms) and shall be liable for any loss that results from any unauthorised use or disclosure.
    7. 4.7You should stay vigilant to fake or fraudulent voice messages, E-mails, SMS messages, WeChat messages, Mobile Banking push notifications or any other means purportedly sent from the Bank. You are advised not to access the Bank’s websites, Internet Banking, Mobile Banking or Mobile Applications through hyperlinks in any E-mail, SMS, QR code, search engine, social networking platform or any third-party websites or Mobile Applications not authorized by the Bank. In case of doubt, you are advised not to follow the instructions of the suspicious pages or input any data. You should keep your password securely. You are also advised not to disclose any personal information to any suspicious third party. If you are concerned you may have disclosed your personal information to any suspicious third party, please contact the Bank immediately.
  5. Intellectual Property
    1. 5.1You understand and accept that all intellectual property rights in the Online Customer Services (including the "look and feel", configuration and appearance of the Online Customer Services, any computer code for operating the Online Customer Services icons, graphical user interfaces, application programming interfaces, text and any other materials posted on the Online Customer Services) are the sole and exclusive property of the Bank, our affiliates or our third party licensors, and you are granted only a limited revocable, non-assignable, non-sublicensable, worldwide licence to use such intellectual property rights for the purpose of using the Online Customer Services only.
    2. 5.2By uploading, submitting, posting or transmitting data, information and materials on the Online Customer Services, you agree to grant the Bank a worldwide perpetual irrevocable non-exclusive royalty free and sub-licensable licence to use, copy, reproduce, process, adapt, publish, create derivative work from, translate, transmit, host and disseminate your content in any media, technology or form.
  6. WeChat Official Accounts Platform
    1. 6.1In order to use the Online Customer Services functions [set out in clause 1.4] through the WeChat Official Accounts Platform, you shall (i) maintain a valid WeChat account; and (ii) follow the Bank's official WeChat account (ID: ccbasiahk).

      The provision of the Online Customer Services through the WeChat Official Accounts Platform is referred to as the "Online Customer Services via WeChat Channel".
    2. 6.2The provision of the Online Customer Services via WeChat Channel is not an e-banking service. The functions that are available through the Online Customer Services via WeChat Channel are limited to those relating to general enquiries about our products and services. Unless otherwise agreed by the Bank, the Online Customer Services via WeChat Channel do not accept any instructions from you regarding your accounts and transactions, and do not process or perform any specific transaction enquiries or other account or transaction related matters. You shall avoid disclosing any personal or account information when using the Online Customer Services via WeChat Channel.
    3. 6.3You understand and accept that:
      1. a.the WeChat Official Accounts Platform is provided by WeChat (not the Bank), and the Bank cannot and does not make any representation, guarantee, warranty or agreement of any kind as to the function, quality, security or applicability of WeChat platforms;
      2. b.the use of the WeChat accounts (including your WeChat account and the WeChat Official Accounts Platform) is subject to WeChat's specific terms and conditions (including the WeChat Privacy Policy and WeChat Acceptable Use Policy) and you are responsible for reviewing and accepting the terms and conditions of WeChat, which create a contractual relationship directly between you and WeChat. The Bank is not a party to the arrangement between you and WeChat;
      3. c.terms and conditions imposed by WeChat, as well as any third party who supports the WeChat Official Accounts Platform, also apply to your use of the Online Customer Services via WeChat Channel. You agree to be bound by such terms and conditions, and you agree that the Bank shall not be liable for any breach by you of the terms and conditions imposed by WeChat or any third party and that you are solely responsible for complying with such terms and conditions and the Bank has no responsibility to notify you of the applicable terms and conditions imposed by WeChat or any third party from time to time (including any changes or amendments to such terms and conditions);
      4. d.WeChat and any third parties who support the WeChat Official Accounts Platform are not agents or representatives of the Bank. There is no partnership, joint venture or other relationship between the Bank and WeChat or any third parties who support the WeChat Official Accounts Platform. The Bank shall not be liable for any action, claim, loss, damage or liability of any nature which you may suffer or incur arising from or in connection with any act or omission of WeChat or any third parties who support the WeChat Official Accounts Platform;
      5. e.you access and use the Online Customer Services via WeChat Channel entirely at your own risk. The Bank cannot warrant that there will be no interruption, delay or mutilation or that there will be no leakage of any personal information, failure of transaction or information error caused by WeChat;
      6. f.you are solely responsible for any fees or charges which may be imposed by WeChat; and
      7. g.the Bank does not assume any liability or responsibility for any acts or omissions of WeChat including but not limited to any system failure or malfunction.
  7. Representations and Warranties
    1. 7.1In providing the Online Customer Services, to the maximum extent permitted by applicable law, the Bank disclaims any and all representations and warranties as to the accuracy, completeness, quality, timeliness, security, reliability or validity of the Online Customer Services, or any content, service or feature of the Online Customer Services, and that your use of the Online Customer Services will be error-free, uninterrupted, secure, free from any viruses or defects in the operation or functionality of the Online Customer Services, or that any defects will be corrected. The Bank shall not guarantee that any particular computer, mobile or other device will be compatible with the Online Customer Services and you acknowledge that you are solely responsible to ensure that your computer, mobile or other device meets the minimum requirements imposed by the Bank.
    2. 7.2Your use of the Online Customer Services is wholly at your own risk. You understand and accept that the Online Customer Services are delivered to you on an "as is" and "as available" basis. You understand and accept that you are solely responsible for any damage to your computers, systems or software (including viruses, bugs, contamination and unauthorised access) or loss of data that results from your use of the Online Customer Services.
    3. 7.3You understand and accept that, to the maximum extent permitted by applicable law, the Bank disclaims all conditions and warranties, express or implied, including but not limited to any conditions and warranties of merchantability, fitness for purpose, and non-infringement in respect of the Online Customer Services. You understand and accept that, to the maximum extent permitted by applicable law, the Bank disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Online Customer Services.
  8. Disclaimer and Limitation of Liability
    1. 8.1The Bank will take reasonably practicable steps to ensure that its systems in connection with the Online Customer Services are installed with adequate security designs and to control and manage the risks in operating the systems, taking into account any law, rules, regulations, guidelines, circulars, codes of conduct and prevailing market practices which may be applicable to the Bank from time to time.
    2. 8.2You acknowledge that the Online Customer Services may not be available for use at all times, and are also subject to (and may suffer failure or delay in processing and/or transmitting information as a result of) interruption, failure of hardware or software, errors, transmission blackout, delayed transmission due to internet traffic or incorrect data transmission due to the public nature of the internet, system failure or upgrades or maintenance or for other reasons. The Bank assumes no liability or responsibility for any consequences arising from failed, inaccurate or untimely transmission of information.
    3. 8.3You agree not to use the Online Customer Services in relation to any devices which are compromised (e.g. "jailbroken" (iOS) or "rooted" (Android)). The Bank shall not be responsible for any problems or losses suffered by you if you attempt to use the Online Customer Services on such devices.
    4. 8.4The Bank does not represent or warrant that viruses or other destructive properties will not be transmitted, or that your mobile device, computer or any other electronic device will not be damaged, during your use of the Online Customer Services.
    5. 8.5You understand and accept that, to the maximum extent permitted under applicable laws,
      1. a.unless there is negligence or wilful default of the Bank, the Bank shall not be liable for any claim, loss or damage suffered or incurred by you arising out of or in connection the Online Customer Services as a result of:
        1. i.any breakdown, failure, mutilation, interruption, omission, error, default, mistake, delay, diminution or down-time of the Online Customer Services or the Online Customer Services not being available or being restricted, suspended, terminated or inoperative;
        2. ii.your failure to carry out your responsibilities as provided in these T&Cs;
        3. iii.any inaccurate or incomplete data, corruption, interception, deletion or loss of data due to fault, failure or malfunction of the Online Customer Services;
        4. iv.any damage or loss to your data, software, mobile or computer device or any other electronic equipment arising from or in connection with the Online Customer Services;
        5. v.any failure, error, action or omission of WeChat or its representatives or affiliates; and/or
        6. vi.any loss of profits or opportunity or any other consequential or indirect loss or liability caused by the use of or inability to use the Online Customer Services or from any errors, inadequacies or failures of any machine, Online Customer Services, website, mobile app, internet, computer system, data processing system or transmission link or any industrial dispute or any other factor outside the control of the Bank or outside the control of the agents or sub-contractors of the Bank, whether caused by negligence or otherwise.
      2. b.you shall be solely responsible for any breach of your obligations under these T&Cs and agree to defend, indemnify and hold harmless the Bank, our officers, employees and any other person appointed by the Bank against all actions, liabilities, claims, demands, losses, damages, fees, expenses and taxes of any kind made against or incurred by the Bank in connection with the any breach of your obligations under these T&Cs, any improper use of the Online Customer Services, or any fraud, wilful misconduct or negligence in your use of the Online Customer Services.
  9. Service Availability and Termination
    1. 9.1The Bank has the right to immediately terminate or suspend your right to use the Online Customer Services without notice if the Bank reasonably decides that you are at any time in breach of any undertaking or provision of these T&Cs or any other related terms and conditions and agreements, or you are no longer eligible to use or access the Online Customer Services for any reason.
    2. 9.2The Bank may terminate or suspend all or part of the Online Customer Services at any time at our sole discretion without notice to you and without providing reasons. The Bank may at our sole discretion determine whether you are eligible to use the Online Customer Services as the Bank considers appropriate.
    3. 9.3To the maximum extent permitted by applicable laws, the Bank shall not be liable for any loss or damage suffered by you as a result of or arising out of any voluntary or involuntary suspension or termination of the Online Customer Services for any reason whatsoever.
    4. 9.4The termination or expiry of these T&Cs shall not affect any actual or contingent liabilities or claims which accrue before these T&Cs terminate or expire.
  10. General
    1. 10.1 We may amend, revise or replace these T&Cs and the General Terms (as applicable) and/or introduce additional terms and conditions from time to time at our sole discretion. By continuing to use the Online Customer Services following any amendment, you will be deemed to have accepted the amended T&Cs or General Terms (as applicable). If you do not agree to any such amendments, you should stop using the Online Customer Services.
    2. 10.2 You cannot assign, transfer or subcontract all or part of your rights and/or obligations under these T&Cs, without the prior written consent of the Bank to be provided at our sole discretion. The Bank may assign, transfer or subcontract all or part of our rights and/or obligations under these T&Cs without your prior written consent.
    3. 10.3 In the event of a conflict between these T&Cs and any of the General Terms, these T&Cs will prevail to the extent of such conflict, insofar as the Online Customer Services are concerned.
    4. 10.4 These T&Cs sets out the entire agreement and understanding between you and the Bank in connection with its subject matter. You have not entered into these T&Cs in reliance on any representation, warranty or undertaking of the Bank, except as expressly referred to in these T&Cs.
    5. 10.5 Each of the provisions of these T&Cs is severable and distinct from the others and, if at any time one or more of such provisions is or becomes illegal, invalid or unenforceable in any respect under the laws of any jurisdiction, the legality, validity and enforceability of the remaining provisions shall not be affected in any way.
    6. 10.6 No act, delay or omission by the Bank shall affect our rights, powers and remedies under these T&Cs or any further or other exercise of such rights, powers and remedies. The rights, powers and remedies of the Bank under these T&Cs are cumulative and not exclusive of the rights, powers and remedies provided by law.
    7. 10.7 No person other than you and the Bank will have any right under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) to enforce or enjoy the benefit of any of the provisions of these T&Cs. Application of the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) is hereby expressly excluded.
    8. 10.8 In the event of any conflict or discrepancy between the English version and Chinese version of these T&Cs, the English version shall prevail.
    9. 10.9 These T&Cs shall be governed by and interpreted in accordance with the laws of Hong Kong and you submit to the non-exclusive jurisdiction of the Hong Kong courts.
    10. 10.10 The obligations in Clauses 6.3(g), 8, 9, 10.3, 10.4, 10.5, 10.6, 10.7, 10.8 and 10.9 survive termination of these T&Cs and shall remain in full force and effect after the expiration or termination of these T&Cs.
